1. Introduction and Overview

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules framed thereunder pertaining to electronic records as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 and the Consumer Protection (E‑Commerce) Rules, 2020 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the bhuvira-rakshati.com website.

The domain name www.bhuvira-rakshati.com (hereinafter referred to as the “Website” or “Platform”) is owned and operated by Harshit Saini, Sole Proprietor of Bhuvira Rakshati, with its principal place of business at 30 B, Phase 3A, Pant Vihar, ITC Road, Saharanpur, Uttar Pradesh (hereinafter referred to as “Bhuvira Rakshati”, “We”, “Us”, “Our”).

Your use of the Platform and the services and tools made available through the Platform are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If You transact on or through the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By accessing, browsing, or otherwise using the Platform, You shall be deemed to have contracted with Bhuvira Rakshati and these terms and conditions including the policies constitute Your binding obligations with Bhuvira Rakshati.

For the purpose of these Terms of Use, wherever the context so requires, “You” or “User” shall mean any natural or legal person who has agreed to become a user of the Platform by providing registration data while registering on the Platform as a registered user or by accessing the Platform on a computer or mobile device or otherwise. Bhuvira Rakshati allows the User to access the Platform or make purchases without registering on the Platform, subject to these Terms of Use.

When You use any of the services provided by Us through the Platform, including but not limited to, product reviews, seller reviews, vendor registration, or any other service, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add, or remove portions of these Terms of Use, at any time without any prior written notice to You. It is Your responsibility to review these Terms of Use periodically for updates and changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions.

BY ACCESSING, BROWSING, OR OTHERWISE USING THIS PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS CONTAINED HEREIN, AS AMENDED FROM TIME TO TIME. BY IMPLYING OR EXPRESSLY ACCEPTING THESE TERMS OF USE, YOU ALSO ACCEPT AND AGREE TO BE BOUND BY BHUVIRA RAKSHATI POLICIES (INCLUDING BUT NOT LIMITED TO THE PRIVACY POLICY AVAILABLE AT /privacy-policy AND ANY OTHER APPLICABLE POLICIES) AS AMENDED FROM TIME TO TIME. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

2. Definitions and Interpretation

2.1 “Buyer” or “Customer” shall mean any individual or legal entity who accesses, browses, or purchases goods or services from a Seller through the Platform, whether as a registered user or otherwise.

2.2 “Platform” shall mean and include the website www.bhuvira-rakshati.com, its mobile‑optimized version, any associated mobile applications, and all sub‑domains thereof.

2.3 “Seller” or “Vendor” shall mean any individual or legal entity duly registered on the Platform in accordance with these Terms to offer goods or services for sale through the Platform, having agreed to the Vendor Terms and Conditions incorporated herein.

2.4 “User” or “You” shall mean any person who accesses, browses, or uses the Platform in any manner, whether as a Buyer, Seller, or a mere visitor, including any natural or legal person who has agreed to become a user on the Platform by providing registration data while registering as a registered user or otherwise.

2.5 “Wallet” shall mean the prepaid payment instrument associated with a User’s account, the terms of which are governed by Clause 11 herein and are subject to the Master Directions on Prepaid Payment Instruments issued by the Reserve Bank of India, as amended from time to time.

2.6 “Content” shall mean and include all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and any and all other materials and information appearing on or made available through the Platform.

2.7 “Transaction” shall mean any purchase, sale, or other commercial interaction between Users facilitated through the Platform.

3. Membership Eligibility and User Registration

3.1 Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including but not limited to minors, undischarged insolvents, and persons of unsound mind, are not eligible to use the Platform. If You are a minor i.e., under the age of 18 years, You shall not register as a User of the Platform and shall not transact on or use the Platform. As a minor, if You wish to use or transact on the Platform, such use or transaction may be made by Your legal guardian or parents on the Platform, and such guardian or parent shall be deemed to have accepted these Terms on Your behalf. Bhuvira Rakshati reserves the right to terminate Your membership and/or refuse to provide You with access to the Platform if it is brought to Bhuvira Rakshati’s notice or if it is discovered that You are under the age of 18 years and the aforementioned conditions are not satisfied.

3.2 If You use the Platform, You shall be responsible for maintaining the confidentiality of Your display name, user ID, and password, if any, and You shall be responsible for all activities that occur under Your display name, user ID, and password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete, or if We have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, or not in accordance with these Terms of Use, We shall have the right to indefinitely suspend or terminate or block access to Your membership on the Platform and refuse to provide You with access to the Platform in whole or in part.

3.3 You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

4. Platform for Transaction and Communication

4.0 Legal Status: The Platform operates as an intermediary marketplace in accordance with the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020. Bhuvira Rakshati acts solely as a facilitator between Buyers and Sellers and qualifies for safe harbour protection under applicable laws.

4.1 The Platform is a medium that enables Users to interact and engage with one another for the purpose of transaction. Bhuvira Rakshati is not and cannot be a party to or control in any manner any transaction between the Platform’s Users. Consequently:

  • (i) All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include, without limitation, price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties, representations related to products and services, and after-sales services related to products and services. Bhuvira Rakshati does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.
  • (ii) Bhuvira Rakshati does not make any representation or warranty as to the specifics (such as quality, value, salability, merchantability, fitness for a particular purpose, etc.) of the products or services proposed to be sold or offered to be sold or purchased on the Platform. Bhuvira Rakshati does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Platform. Bhuvira Rakshati accepts no liability for any errors or omissions, whether on behalf of itself or third parties, in relation to any product or service listing.
  • (iii) Bhuvira Rakshati is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers. Bhuvira Rakshati cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Platform. Bhuvira Rakshati shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers, except as expressly provided under Clause 16 (Dispute Resolution) herein.
  • (iv) Bhuvira Rakshati does not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, bona fides, etc.) of any of its Users. You are advised to independently verify the bona fides of any particular User that You choose to deal with on the Platform and use Your best judgment in that behalf.
  • (v) Bhuvira Rakshati does not at any point in time during any transaction between Buyer and Seller on the Platform come into or take possession of any of the products or services offered by Seller, nor does it at any point gain title to or have any rights or claims over the products or services offered by Seller to Buyer. The Platform is only a medium through which Buyers and Sellers may interact and complete transactions.
  • (vi) At no time shall Bhuvira Rakshati hold any right, title, or interest over the products, nor shall Bhuvira Rakshati have any obligations or liabilities in respect of such contract entered into between Buyers and Sellers, including but not limited to obligations or liabilities arising out of any unsatisfactory or delayed performance of services, damages or delays as a result of products which are out of stock, unavailable, back ordered, or otherwise.
  • (vii) The Platform is only a platform that can be utilized to reach a larger base to buy and sell products or services. Bhuvira Rakshati is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Seller and the Buyer.
  • (viii) You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance, etc. with the seller(s) that You transact with.
  • (ix) Pricing on any product(s) as is reflected on the Platform may, due to some technical issue, typographical error, or incorrect product information published by seller, be incorrectly reflected, and in such an event, seller may cancel such your order(s) without any liability to Bhuvira Rakshati.

4.2 You release and indemnify Bhuvira Rakshati and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any of the actions of the Users of the Platform and specifically waive any claims that You may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, Bhuvira Rakshati cannot take responsibility or control the information provided by other Users which is made available on the Platform. You may find other User’s information to be offensive, harmful, inconsistent, inaccurate, or deceptive. Please use caution and practice safe trading when using the Platform.

4.3 Please note that there could be risks in dealing with underage persons or people acting under false pretense. Bhuvira Rakshati shall not be responsible for any such risks.

5. Fees and Charges

5.1 Membership on the Platform is free for Buyers. Bhuvira Rakshati does not charge any fee for browsing and buying on the Platform. However, Bhuvira Rakshati reserves the right to change its Fee Policy from time to time. In particular, Bhuvira Rakshati may at its sole discretion introduce new services and modify some or all of the existing services offered on the Platform. In such an event, Bhuvira Rakshati reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Platform and such changes shall automatically become effective immediately after they are posted on the Platform.

5.2 Unless otherwise stated, all fees and charges shall be quoted in Indian Rupees. You shall be solely responsible for compliance with all applicable laws including those in India for making payments to Bhuvira Rakshati.

5.3 Sellers may be required to pay subscription fees, commissions, listing fees, or such other charges as may be determined by Bhuvira Rakshati from time to time in its sole discretion. The applicable fee structure shall be communicated to Sellers and posted on the Platform. Sellers acknowledge and agree that such fees are non‑refundable except as expressly provided otherwise.

5.4 Commission and Platform Fees: Bhuvira Rakshati operates as a marketplace platform and may charge Sellers a commission, listing fee, subscription fee, or service fee for facilitating transactions. Such fees shall be communicated to Sellers and may be updated from time to time.

5.5 GST on Fees: All fees charged by Bhuvira Rakshati shall be subject to applicable Goods and Services Tax (GST) under Indian law. Bhuvira Rakshati shall issue valid tax invoices for such fees in accordance with the GST Act, 2017.

5.6 Seller Tax Responsibility: Sellers are solely responsible for determining, collecting, and remitting applicable GST on the sale of their products or services. Bhuvira Rakshati shall not be responsible for any incorrect tax classification or non-compliance by Sellers.

5.7 Payment Collection and Settlement: Bhuvira Rakshati may collect payments on behalf of Sellers for transactions conducted on the Platform. Such payments shall be remitted to Sellers after deduction of applicable fees, commissions, taxes, refunds, penalties, or other charges.

5.8 Settlement Timeline: Payments to Sellers shall be processed within a reasonable time period as determined by Bhuvira Rakshati, subject to order completion, return periods, and verification processes.

5.9 Right to Withhold or Adjust Payments: Bhuvira Rakshati reserves the right to withhold, deduct, or adjust any payments due to Sellers in case of refunds, disputes, chargebacks, policy violations, or legal requirements.

6. Use of the Platform (User Conduct)

You agree, undertake, and confirm that Your use of the Platform shall be strictly governed by the following binding principles:

6.1 You shall not host, display, upload, modify, publish, transmit, update, or share any information or content which:

  • (a) belongs to another person and to which You does not have any right to;
  • (b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
  • (c) is misleading in any way;
  • (d) is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
  • (e) harasses or advocates harassment of another person;
  • (f) involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”;
  • (g) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libellous;
  • (h) infringes upon or violates any third party’s rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address, or phone number) or rights of publicity];
  • (i) promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture‑installed copy‑protected devices, or providing pirated music or links to pirated music files;
  • (j) contains restricted or password‑only access pages, or hidden pages or images (those not linked to from another accessible page);
  • (k) provides material that exploits people in a sexual, violent, or otherwise inappropriate manner or solicits personal information from anyone;
  • (l) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
  • (m) contains video, photographs, or images of another person without their consent (with a minor or an adult);
  • (n) tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend requests, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
  • (o) engages in commercial activities and/or sales without Our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes, or the buying or selling of “virtual” products related to the Platform. Throughout these Terms of Use, Bhuvira Rakshati’s prior written consent means a communication coming from Bhuvira Rakshati’s authorized representative, specifically in response to Your request, and specifically addressing the activity or conduct for which You seek authorization;
  • (p) solicits gambling or engages in any gambling activity which We, in Our sole discretion, believes is or could be construed as being illegal;
  • (q) interferes with another USER’s use and enjoyment of the Platform or any other individual’s User and enjoyment of similar services;
  • (r) refers to any website or URL that, in Our sole discretion, contains material that is inappropriate for the Platform or any other website, contains content that would be prohibited, or violates the letter or spirit of these Terms of Use;
  • (s) harms minors in any way;
  • (t) infringes any patent, trademark, copyright, or other proprietary rights or third party’s trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;
  • (u) violates any law for the time being in force;
  • (v) deceives or misleads the addressee/users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
  • (w) impersonates another person;
  • (x) contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept, or expropriate any system, data, or personal information;
  • (y) threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;
  • (z) is false, inaccurate, or misleading;
  • (aa) directly or indirectly, offers, attempts to offer, trades, or attempts to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation, or guideline for the time being in force;(ab) creates liability for Us or causes Us to lose (in whole or in part) the services of Our internet service provider (“ISPs”) or other suppliers.

6.2 You shall not use any “deep‑link”, “page‑scraper”, “robot”, “spider”, or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents, or information through any means not purposely made available through the Platform. We reserve Our right to bar any such activity.

6.3 You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password “mining”, or any other illegitimate means.

6.4 You shall not probe, scan, or test the vulnerability of the Platform or any network connected to the Platform, nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look‑up, trace, or seek to trace any information on any other User of or visitor to Platform, or any other customer, including any account on the Platform not owned by You, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the Platform.

6.5 You shall not make any negative, denigrating, or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us including the terms Bhuvira Rakshati, or otherwise engage in any conduct or action that might tarnish the image or reputation of Bhuvira Rakshati or sellers on platform or otherwise tarnish or dilute any Bhuvira Rakshati’s trade or service marks, trade name, and/or goodwill associated with such trade or service marks, trade name as may be owned or used by Us. You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or Bhuvira Rakshati’s systems or networks, or any systems or networks connected to Bhuvira Rakshati.

6.6 You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform.

6.7 You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the Platform or any service offered on or through the Platform. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.

6.8 You may not use the Platform or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Bhuvira Rakshati and/or others.

6.9 You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including, but not limited to, Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

6.10 Solely to enable Us to use the information You supply Us with, so that we are not violating any rights You might have in Your Information, You agree to grant Us a non‑exclusive, worldwide, perpetual, irrevocable, royalty‑free, sub‑licensable (through multiple tiers) right to exercise the copyright, publicity, database rights, or any other rights You have in Your Information, in any media now known or not currently known, with respect to Your Information. We will only use Your information in accordance with the Terms of Use and Privacy Policy applicable to use of the Platform.

6.11 From time to time, You shall be responsible for providing information relating to the products or services proposed to be sold by You. In this connection, You undertake that all such information shall be accurate in all respects. You shall not exaggerate or over‑emphasize the attributes of such products or services so as to mislead other Users in any manner.

6.12 You shall not engage in advertising to, or solicitation of, other Users of the Platform to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Platform or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other Users via the Platform. It shall be a violation of these Terms of Use to use any information obtained from the Platform in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than Us without Our prior explicit consent. In order to protect Our Users from such advertising or solicitation, We reserve the right to restrict the number of messages or emails which a user may send to other Users in any 24‑hour period which We deem appropriate in its sole discretion. You understand that We have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Platform) as necessary to satisfy any law, regulation, or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena. In addition, We can (and You hereby expressly authorize Us to) disclose any information about You to law enforcement or other government officials, as we, in Our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.

6.13 We reserve the right, but have no obligation, to monitor the materials posted on the Platform. Bhuvira Rakshati shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST ON THE PLATFORM AND IN YOUR PRIVATE MESSAGES. Please be advised that such Content posted does not necessarily reflect Bhuvira Rakshati views. In no event shall Bhuvira Rakshati assume or have any responsibility or liability for any Content posted or for any claims, damages, or losses resulting from use of Content and/or appearance of Content on the Platform. You hereby represent and warrant that You have all necessary rights in and to all Content which You provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortious, or otherwise unlawful information.

6.14 Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Platform, including payment and delivery of related products or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between You and such advertiser. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Platform.

6.15 It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Platform and that You may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about You due to your use of the Platform, and that the recipient may use such information to harass or injure You. We do not approve of such unauthorized uses, but by using the Platform You acknowledge and agree that We are not responsible for the use of any personal information that You publicly disclose or share with others on the Platform. Please carefully select the type of information that You publicly disclose or share with others on the Platform.

6.16 Bhuvira Rakshati shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services) attacks or any other similar malicious activities.

6.17 Seller-Specific Compliance: Sellers shall ensure that all products listed on the Platform comply with applicable laws, including but not limited to consumer protection laws, environmental regulations, and GST laws. Any false, misleading, or unsubstantiated claims including but not limited to “eco-friendly”, “organic”, “sustainable”, or similar representations shall be the sole responsibility of the Seller.

6.18 Right to Remove Listings: Bhuvira Rakshati reserves the right to remove, suspend, or restrict any product listing, content, or Seller account that violates applicable laws, these Terms of Use, or platform policies, without prior notice.

6.19 Verification and Audit Rights: Bhuvira Rakshati reserves the right to verify, audit, and request documents from Sellers to ensure compliance with applicable laws and platform policies, including but not limited to GST registration, certifications, and product authenticity.

6.20 Prohibited Products: Sellers shall not list or sell any products that are prohibited under applicable laws, including but not limited to counterfeit goods, restricted items, or products requiring special licenses without valid authorization.

6.21 Enforcement and Penalties: In case of violation of these Terms, Bhuvira Rakshati reserves the right to suspend or terminate accounts, withhold payments, remove listings, and take appropriate legal action.

7. Content Posted on Site

7.1 All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel,” and arrangement of such Content, contained on the Platform is owned, controlled, or licensed by or to Bhuvira Rakshati, and is protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.

7.2 Except as expressly provided in these Terms of Use, no part of the Platform and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, website, or other medium for publication or distribution or for any commercial enterprise, without Bhuvira Rakshati’s express prior written consent.

7.3 You may use information on the products and services purposely made available on the Platform for downloading, provided that You (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non‑commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such documents.

7.4 Any Content posted by You on the Platform, including but not limited to any notes, messages, emails, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files, or other materials or information (collectively, “User Content”), shall become Our property and You grant Us the worldwide, perpetual, and transferable rights in such User Content. We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the User Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the User Content You provide. You agree that any User Content You post may be used by us, consistent with Our Privacy Policy and Rules of Conduct on Site as mentioned herein, and You are not entitled to any payment or other compensation for such use.

7.5 Seller Content Responsibility: Sellers shall be solely responsible for all content, product descriptions, images, claims, and representations made in their listings. Sellers represent and warrant that such content is accurate, lawful, and does not infringe any intellectual property rights or mislead consumers.

7.6 No Platform Liability for Content: Bhuvira Rakshati acts as an intermediary and shall not be responsible for any content uploaded by Users or Sellers, including but not limited to product descriptions, images, claims, or reviews.

7.7 Content Removal Rights: Bhuvira Rakshati reserves the right to remove, disable, or restrict access to any content that violates applicable laws, these Terms, or upon receiving a valid complaint, without prior notice.

7.8 Intellectual Property Infringement: If any User believes that their intellectual property rights have been infringed, they may notify Bhuvira Rakshati with sufficient details, and the Platform may take appropriate action including removal of such content.

7.9 Indemnity for Content: Users and Sellers agree to indemnify and hold harmless Bhuvira Rakshati against any claims arising from content uploaded or shared on the Platform.

8. Privacy and Data Protection (DPDP Act, 2023 Compliance)

8.1 We view the protection of Your privacy as a very important principle. We understand clearly that You and Your Personal Information is one of Our most important assets. We store and process Your Information including any sensitive personal data or information (as defined under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023), on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with applicable laws.

8.2 The collection, processing, storage, and usage of Your personal data shall be governed by the provisions of the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules framed thereunder, as amended from time to time. By using the Platform, You provide Your explicit consent to the collection, processing, storage, and usage of Your personal data in accordance with the DPDP Act and Our Privacy Policy.

8.3 Our current Privacy Policy is available at /privacy-policy. If You object to Your Information being transferred or used in this way, please do not use the Platform.

8.4 We and our affiliates may share, sell, transfer, license, or convey some or all of your personal information with another business entity should we (or our assets) plan to merge with or be acquired by that business entity, or undergo any reorganization, amalgamation, or restructuring of business for any reason whatsoever. Should such a transaction or situation occur, the other business entity or the new combined entity will be required to follow the privacy policy with respect to your personal information.

8.5 Once you provide your information to us, you provide such information to us and our affiliates, and our affiliates may use such information to provide you various services with respect to your transaction whether such transactions are conducted on www.bhuvira-rakshati.com or with third‑party merchants or third‑party merchant’s websites.

8.6 You have the right to access, correct, update, or request erasure of Your personal data in accordance with the DPDP Act, 2023. Any such requests may be directed to Our Grievance Officer.

9. Disclaimer of Warranties and Liability

9.1 This Platform, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this site are provided on “as is” and “as available” basis without any representation or warranties, express or implied, except otherwise specified in writing. Without prejudice to the foregoing paragraph, Bhuvira Rakshati does not warrant that:

  • (i) This Platform will be constantly available, or available at all; or
  • (ii) The information on this Platform is complete, true, accurate, or non‑misleading.

9.2 Bhuvira Rakshati will not be liable to You in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Platform. Bhuvira Rakshati does not warrant that this site, information, Content, materials, product (including software) or services included on or otherwise made available to You through the Platform, their servers, or electronic communication sent from Us are free of viruses or other harmful components.

9.3 Nothing on the Platform constitutes, or is meant to constitute, advice of any kind. All the products sold on the Platform are governed by different state laws and if Seller is unable to deliver such Products due to implications of different state laws, Seller will return or will give credit for the amount (if any) received in advance by Seller from the sale of such Product that could not be delivered to You.

9.4 You will be required to enter a valid phone number while placing an order on the Platform. By registering Your phone number with Us, You consent to be contacted by Us via phone calls and/or SMS notifications, in case of any order or shipment delivery related updates. We will not use your personal information to initiate any promotional phone calls or SMS without your express consent.

9.5 Intermediary Status: Bhuvira Rakshati operates as an intermediary under the Information Technology Act, 2000 and shall be entitled to safe harbour protections. The Platform shall not be liable for any third-party content, listings, or transactions conducted between Users.

9.6 Third-Party Services: The Platform may use third-party service providers including payment gateways, logistics providers, and technical service providers. Bhuvira Rakshati shall not be responsible for any errors, delays, failures, or damages caused by such third-party services.

9.7 No Guarantee of Sales or Outcomes: Bhuvira Rakshati does not guarantee any minimum sales, customer traffic, revenue, or business outcomes for Sellers using the Platform.

9.8 Service Availability: The Platform may be unavailable from time to time due to maintenance, upgrades, technical issues, or circumstances beyond control. Bhuvira Rakshati does not guarantee uninterrupted or error-free operation of the Platform.

9.9 Force Majeure: Bhuvira Rakshati shall not be liable for any failure or delay in performance due to events beyond its reasonable control including but not limited to natural disasters, government actions, internet failures, or technical disruptions.

10. Wallet Terms (Prepaid Payment Instrument)

10.0 Nature of Wallet: The Wallet provided on the Platform is a limited-purpose digital ledger system for facilitating transactions and is NOT a prepaid payment instrument under the Reserve Bank of India regulations unless explicitly stated. Bhuvira Rakshati does not operate as a bank, financial institution, or payment system operator.

10.1 The Wallet (“Wallet”) is a prepaid payment instrument which is associated with your Platform account. You may maintain a balance of money with such specific Seller (if permitted), and redeem it at your convenience subject to the terms and conditions contained herein and the Master Directions on Prepaid Payment Instruments issued by the Reserve Bank of India, as amended from time to time. Please note that Seller will be the issuer of wallet and Seller shall be responsible for redeeming the money lying to your credit of your wallet account and Bhuvira Rakshati does not assume any risk, liability, or responsibility with respect to wallet money, except to the extent mandated by law.

10.2 Seller will not pay any interest on the amount maintained by you in your Seller specific Wallet.

10.3 REFILL OF WALLET: Your Wallet can be refilled, using any of the prepaid payment options available on the Platform. You will be able to recharge your Wallet up to the limits prescribed by RBI guidelines from time to time. There is no need to maintain a minimum balance, unless otherwise specified.

10.4 REFUND OF WALLET AMOUNT: Your Wallet comprises of three types of balances:

  • (i) Store credit: which is a credit granted by Us typically in lieu of a cancelled order, refund, or promotional credit;
  • (ii) Topped‑up balance: which is a prepaid amount that You added to the Wallet to pay for future orders on the Platform; and
  • (iii) Promotional balance: which is credit granted by Us purely for promotional or goodwill purposes.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT TOPPED‑UP BALANCE (PREPAID AMOUNT) AS WELL AS THE PROMOTIONAL BALANCE ADDED TO THE WALLET SHALL BE NON‑REFUNDABLE AND NON‑WITHDRAWABLE. Such balances can only be utilized for making purchases on the Platform and cannot be converted to cash, transferred to any bank account, or withdrawn through any other payment instrument. Store credit, however, shall continue to be refundable in accordance with applicable laws and policies.

10.5 LIMITATION OF LIABILITY: In no event will Bhuvira Rakshati be liable for any money lying to your credit in wallet, or for any special, incidental, indirect, or consequential damages or losses of any kind, arising from the use of Wallet or association with the Wallet, including but not limited to any loss arising out of any act or omission of any Seller in relation to the Wallet.

10.6 Payment Processing: All payments on the Platform are processed through authorized third-party payment gateways. Bhuvira Rakshati does not store or process sensitive payment information directly.

10.7 Limited Liability: Bhuvira Rakshati shall not be liable for any loss of Wallet balance arising from technical errors, unauthorized access, or third-party failures, except to the extent required under applicable law.

10.8 Refund and Usage Conditions: Any Wallet balance, credits, or promotional amounts may be subject to usage conditions, expiry, or restrictions as communicated on the Platform and in compliance with applicable laws.

10.9 Fraud and Misuse: Bhuvira Rakshati reserves the right to suspend or restrict Wallet usage in case of suspected fraud, misuse, or violation of platform policies.

11. 7‑Day Replacement and Return Policy

11.0 Role of Platform: Bhuvira Rakshati acts solely as an intermediary marketplace and does not directly process returns or refunds unless explicitly stated. All return and refund obligations are primarily between the Buyer and the Seller.

11.1 The 7‑Day Replacement Guarantee seeks to assist Buyers who have been defrauded by qualified sellers on the Platform. If at the time of delivery and/or within SEVEN (7) DAYS from the date of delivery of the product/s, if any defect is found, then the buyer of the product/s can request return or replacement of the product/s from the seller subject to the following terms and conditions:

  • (i) Notify seller of any defects in the product/s at the time of delivery of the product/s and/or within 7 days from the date of delivery and the same product/s will be replaced in return of the defective product/s.
  • (ii) Replacement can be for the entire product/s or part/s of the product subject to availability of the same with the seller.

11.2 Following products shall not be eligible for return or replacement:

  • (i) Damages due to misuse of product;
  • (ii) Incidental damage due to malfunctioning of product;
  • (iii) Any consumable item which has been used/installed;
  • (iv) Products with tampered or missing serial/UPC numbers;
  • (v) Digital products/services;
  • (vi) Any damage/defect which are not covered under the manufacturer’s warranty;
  • (vii) Any product that is returned without all original packaging and accessories, including the box, manufacturer’s packaging if any, and all other items originally included with the product/s delivered;
  • (viii) Products that are custom‑made or personalized according to customer’s specifications.

11.3 For Clothing, Footwear, and Accessories, sellers may accept returns subject to the following conditions:

  • (i) Clothes and footwear are not used (other than for trial), altered, washed, soiled, or damaged in any way;
  • (ii) Original tags and packaging should be intact;
  • (iii) For items that come in branded packaging, the box should be undamaged.

11.4 Innerwear, lingerie, socks, and similar intimate apparel are not covered under the return policy.

11.5 If Bhuvira Rakshati has suspicion or knowledge that any of its buyers and sellers are involved in any activity that is intended to provide claims or information that is false, misleading, or not genuine, then Bhuvira Rakshati may, while reserving its rights to initiate civil and/or criminal proceedings against such user, may also at its sole discretion suspend, block, restrict, cancel the display name of such buyer and seller and/or disqualify that user and any related users from availing protection through this program.

11.6 Bhuvira Rakshati reserves its right to initiate civil and/or criminal proceedings against a user who files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, Bhuvira Rakshati may at its sole discretion suspend, block, restrict, cancel the display name [and its related display names] of such user and/or disqualify that user and any related users from availing protection through this program. Any person who, knowingly and with intent to injure, defraud, or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.

11.7 Seller Responsibility: Sellers shall be solely responsible for accepting returns, processing refunds, and resolving customer complaints in accordance with their stated policies and applicable laws.

11.8 Refund Source: Any refund issued shall be the responsibility of the respective Seller, and Bhuvira Rakshati shall not be liable to fund or guarantee such refunds.

11.9 Refund Timeline: Refunds shall be processed within a reasonable period as per the Seller’s policy and applicable law, subject to product verification and return conditions.

11.10 Return Approval: Sellers reserve the right to inspect returned products and may reject return or refund requests if the product does not meet the return eligibility criteria.

11.11 Shipping Costs: Return shipping costs shall be borne by the Buyer or Seller as per the Seller’s return policy, unless otherwise required under applicable law.

11.12 Platform Limitation: Bhuvira Rakshati shall not be liable for any disputes arising from returns, refunds, or product conditions, and may only facilitate communication between Buyer and Seller.

12. Seller Terms and Obligations

12.1 As a registered seller, you are allowed to list item(s) for sale on the Website in accordance with the Policies which are incorporated by way of reference in this Terms of Use. You must be legally able to sell the item(s) you list for sale on our Website. You must ensure that the listed items do not infringe upon the intellectual property, trade secret, or other proprietary rights or rights of publicity or privacy rights of third parties. Listings may only include text descriptions, graphics, and pictures that describe your item for sale. All listed items must be listed in an appropriate category on the Website. All listed items must be kept in stock for successful fulfilment of sales.

12.2 The listing description of the item must not be misleading and must describe actual condition of the product. If the item description does not match the actual condition of the item, you agree to refund any amounts that you may have received from the Buyer.

12.3 You agree not to list a single product in multiple quantities across various categories on the Website. Bhuvira Rakshati reserves the right to delete such multiple listings of the same product listed by you in various categories.

12.4 Sellers hereby represent and warrant that:

  • (i) They have all necessary rights, licenses, permissions, and authorizations to list, offer, sell, and distribute the products and services listed on the Platform;
  • (ii) The products and services listed do not infringe any intellectual property rights, proprietary rights, or other rights of any third party;
  • (iii) The products and services listed comply with all applicable laws, regulations, guidelines, and safety standards;
  • (iv) All descriptions, representations, and claims regarding the products and services, including any claims regarding eco‑friendly, sustainable, organic, or similar attributes, are true, accurate, verifiable, and compliant with applicable advertising and consumer protection laws;
  • (v) They shall maintain adequate inventory to fulfill orders placed through the Platform;
  • (vi) They shall fulfill all orders in a timely manner and in accordance with the terms agreed with the Buyer.

12.5 Sellers shall indemnify and hold harmless Bhuvira Rakshati, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • (i) Any breach of these Terms by the Seller;
  • (ii) Any claim by a Buyer or any third party regarding the products or services sold by the Seller;
  • (iii) Any infringement of any intellectual property rights or other rights of any third party;
  • (iv) Any violation of applicable laws, rules, or regulations by the Seller;
  • (v) Any negligent or wrongful act or omission of the Seller or its employees, agents, or representatives.

12.6 Complete Seller Liability: Sellers shall bear sole and complete responsibility for all products, services, listings, representations, warranties, delivery, and customer interactions. Bhuvira Rakshati shall not be liable for any claims arising out of Seller activities.

12.7 GST and Tax Compliance: Sellers shall be solely responsible for complying with all applicable tax laws including GST registration, collection, filing, and issuance of valid tax invoices. Bhuvira Rakshati shall not be liable for any tax non-compliance by Sellers.

12.8 Commission and Payment Terms: Sellers agree that Bhuvira Rakshati may deduct applicable commissions, fees, taxes, refunds, penalties, and other charges before remitting payments. Sellers accept the Platform’s settlement process as final and binding.

12.9 Return and Refund Liability: Sellers shall be solely responsible for accepting returns, issuing refunds, and handling disputes with Buyers in accordance with their policies and applicable laws.

12.10 Platform Control Rights: Bhuvira Rakshati reserves the right to suspend, terminate, or restrict Seller accounts, remove listings, or withhold payments in case of policy violations, legal requirements, or disputes.

12.11 Environmental and Product Claims: Sellers shall ensure that any claims related to sustainability, eco-friendliness, organic nature, or similar attributes are accurate, verifiable, and compliant with applicable laws. Sellers shall be solely liable for any misleading or false claims.

12.12 Legal Cooperation: Sellers agree to cooperate with Bhuvira Rakshati and relevant authorities in case of any investigation, legal notice, or regulatory requirement related to their products or activities.

13. Indemnity

13.1 You shall indemnify and hold harmless Bhuvira Rakshati, its owners, licensees, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of these Terms of Use, Privacy Policy, and other Policies, or Your violation of any laws, rules, or regulations or the rights (including infringement of intellectual property rights) of a third party.

13.2 Seller-Specific Indemnity: Without prejudice to the general indemnity above, Sellers agree to fully indemnify and hold harmless Bhuvira Rakshati against any and all claims, disputes, losses, damages, penalties, costs, or expenses arising from their products, services, listings, or conduct on the Platform.

13.3 Scope of Indemnity: Such indemnity shall include, without limitation, claims arising from product defects, misrepresentation, violation of consumer protection laws, GST non-compliance, intellectual property infringement, misleading advertisements, or any breach of applicable laws.

13.4 Legal Costs and Expenses: Sellers and Users agree to indemnify Bhuvira Rakshati for all legal costs, attorney fees, penalties, and expenses incurred in defending any such claims.

13.5 Continuity of Indemnity: The obligations under this Clause shall survive termination or suspension of User or Seller accounts.

13.6 Right to Defense: Bhuvira Rakshati reserves the right to assume exclusive control of defense and settlement of any claim, and Users and Sellers shall fully cooperate in such defense.

14. Grievance Officer and Dispute Resolution

14.1 In accordance with the Information Technology Act, 2000 and the rules made thereunder, the Consumer Protection (E‑Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, the name and contact details of the Grievance Officer are provided below:

14.2 Any grievance, complaint, or concern regarding the Platform, these Terms, or any transaction may be submitted to the Grievance Officer at the contact details provided above. Such grievances shall be acknowledged within forty‑eight (48) hours and redressed within one (1) month from the date of receipt, in accordance with applicable laws.

14.3 DISPUTE RESOLUTION PROCESS: In the event of any dispute arising out of or in connection with these Terms or any transaction on the Platform, the following procedure shall apply:

  • (i) Informal Resolution: The parties shall first attempt to resolve the dispute informally through communication with the Grievance Officer.
  • (ii) Mediation: If the dispute cannot be resolved informally within thirty (30) days, the parties may attempt to resolve it through mediation at a mutually agreed venue in New Delhi.
  • (iii) Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India. The parties hereby submit to the EXCLUSIVE JURISDICTION of the courts at NEW DELHI for the resolution of all disputes arising under these Terms.

14.4 CLASS ACTION WAIVER: You agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and that You will not seek to have any dispute heard as a class action, representative action, or consolidated action.

14.5 Platform Role in Grievances: Bhuvira Rakshati acts as an intermediary and shall facilitate communication between Buyers and Sellers for grievance resolution. However, the primary responsibility for resolving product-related complaints shall lie with the respective Seller.

14.6 Compliance with E-Commerce Rules: Bhuvira Rakshati shall comply with the Consumer Protection (E-Commerce) Rules, 2020, including acknowledgment of complaints within 48 hours and resolution within one month, as applicable.

14.7 Mode of Complaint Submission: Users may submit grievances through email, contact forms, or other electronic means provided on the Platform.

14.8 Limitation of Dispute Resolution: Bhuvira Rakshati shall not be liable to guarantee resolution of disputes between Buyers and Sellers and shall not be responsible for any outcome of such disputes.

14.9 Record Maintenance: Bhuvira Rakshati may maintain records of complaints, communications, and resolutions for compliance and legal purposes.

15. Applicable Law and Jurisdiction

15.1 These Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in NEW DELHI.

15.2 Electronic Transactions: These Terms shall apply to all online and electronic transactions conducted through the Platform and shall be governed in accordance with applicable laws in India.

15.3 Exclusive Jurisdiction: Subject to Clause 14 (Dispute Resolution), all disputes shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.

15.4 Conflict of Laws: The application of any conflict of law principles is expressly excluded to the fullest extent permitted by law.

15.5 Severability: If any provision of these Terms is held to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.

16. Jurisdictional Issues / Sale in India Only

16.1 Unless otherwise specified, the material on the Platform is presented solely for the purpose of sale in India. Bhuvira Rakshati makes no representation that materials in the Platform are appropriate or available for use in other locations/countries other than India. Those who choose to access this site from other locations/countries other than India do so on their own initiative and Bhuvira Rakshati is not responsible for supply of products/refund for the products ordered from other locations/countries other than India, compliance with local laws, if and to the extent local laws are applicable.

16.2 Geographic Limitation: The Platform is intended for use within India only. Delivery of products and services shall be restricted to locations within India unless explicitly stated otherwise.

16.3 Currency: All transactions on the Platform shall be conducted in Indian Rupees (INR) unless otherwise specified.

16.4 International Access: Users accessing the Platform from outside India do so at their own risk, and Bhuvira Rakshati shall not be responsible for compliance with local laws, taxes, or regulations applicable in such jurisdictions.

16.5 Seller Compliance with Indian Laws: Sellers shall ensure that all products listed and sold comply with applicable Indian laws, including taxation, consumer protection, and product safety regulations.

16.6 Cross-Border Restrictions: Bhuvira Rakshati shall not be liable for any issues arising from cross-border transactions, including customs duties, import restrictions, or international payment failures.

17. Trademark, Copyright, and Restriction

17.1 This site is controlled and operated by Bhuvira Rakshati and products are sold by respective Sellers. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights.

17.2 Material on the Website is solely for Your personal, non‑commercial use. You must not copy, reproduce, republish, upload, post, transmit, or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non‑commercial use is a violation of the copyrights, trademarks, and other proprietary rights, and is prohibited. Any use for which You receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

17.3 Seller Intellectual Property Responsibility: Sellers shall ensure that all content, images, trademarks, logos, and product descriptions used in their listings do not infringe any intellectual property rights of third parties. Sellers shall be solely responsible for any such infringement.
